Sterms agreed upon a surrogacy contract with Mart Beth Whitehead. The baby was conceived through William Sterm’s sperm and Mary Whitehead’s egg cells. However, after the baby was born, Whitehead decided to keep the child, and was sued by the Sterms, who wanted to be recognized as the child legal parents. The New Jersey court, ruled the contact as invalid, and recognized Whitehead as the legal mother, because the child is genetically related to her and William Sterm. However, the Sterms were given full legal custody of the child in considering “the best interests of the child.” Whitehead was granted visitation rights. However, when the child, Melissa Sterm, reached “the age of majority in March 2004,…[she] legally terminated Mary Beth's parental rights and formalized Betsy's maternity through adoption proceedings.” This adds more emotional pain for the surrogate, who’s legal child doesn’t want her surrogate mother to be a part of her life.

She went to the extent of lying and risking her health and even not giving herself time to fall in love from always giving birth to other people’s babies. She says she was “happy,” but was she?
